New Greek Insolvency Code

After several decades of discussions and preparatory works an Insolvency Code was finally submitted earlier this year before the Greek parliament and ratified by Law 3588/2007. The new law abolishes the obsolete provisions of any previous legal act which proved to be inefficient to tackle all the particularities of an insolvency procedure. The new Code

According to this recent amendment, Presidential Decree 219/1991 on commercial agents shall now equally apply to exclusive distributors. The said amendment has come to reflect recent case law by the Greek Supreme Court (Decision no 139/2006) and to finally settle a matter that had created major controversy among national courts and scholars in the past.

Ministerial Decision 83657/2006 implements Directive 2001/83 on a community code for medicinal products for human use (as amended by Directives 2004/27 and 2004/24) while, at the same time, it constitutes a codification of all existing Greek legislation on pharmaceutical products, thus, comprising a one-stop shop for pharmaceutical legislation in force.
