Our law firm successfully represented a Greek institution with a leading position in the insurance sector in a court dispute against an individual seeking an injunction relief against our Client. The opposing party requested the suspension of enforcement procedure against his assets, alleging that such enforcement is abusive due to the lapse of a 20-year period from the issuance of the judgement being enforced, according to the Article 281 of the Greek Civil Code. The Court adopted our legal argumentation that simply pleading the longtime inactivity on the creditor’s part and that the latter created the reasonable belief to the debtor that there is no right or that it will not be exercised, is not sufficient to render the subsequent exercise of the right, abusive.
