CLF successfully represented the Greek subsidiary of a leading pharmaceutical group of companies against an alleged commercial agent, seeking goodwill compensation and damages for purported wrongful termination of a co-promotion agreement pertaining to prescription medicinal products. The case involved the borderline legal issue as to whether the activity of providing promotional services for prescription medicinal products to healthcare professionals, following the Market Authorization Holder’s instructions, falls within the scope of PD 219/1991 on commercial agency, either directly or per analogiam. The matter of interpretation of the unilateral act of termination of the agreement was also addressed.
The Court of First Instance and the Court of Appeals adopted fully the line of argumentation advanced by our client and dismissed the complaint on all counts.
